Terms of Service

1. Scope

These terms govern the use of the KumoCert service (the “Service”) between the operator of the Service (“we/us”) and registered users (“you”). By using the Service you agree to these terms. The Japanese version of these terms prevails in case of any inconsistency.

2. Accounts

You must register with accurate information. You are responsible for your account and may not share or transfer it. We may suspend accounts involved in unauthorized use.

3. Paid services

Details, prices and validity periods of paid passes are shown at the point of purchase. Payments are processed by our payment processor (Stripe). Because the content is digital, purchases are in principle non-refundable, except where the Service was unavailable for reasons attributable to us.

4. Intellectual property

All questions, explanations and other content are owned by us or their rightful owners. You may not copy, republish, redistribute or sell content beyond personal use.

5. Prohibited conduct

You must not: (1) copy, republish or share questions or explanations; (2) share or transfer accounts; (3) attempt unauthorized access or impose excessive load on the Service; (4) violate applicable laws; (5) engage in any other conduct we reasonably deem inappropriate.

6. Disclaimer

The Service supports your studies but does not guarantee that you will pass any exam. To the extent permitted by law, our liability is limited to the amount you paid us in the preceding 12 months, except in cases of willful misconduct or gross negligence.

7. Changes to the Service

We may change or discontinue the Service with prior notice. If you hold a pass with remaining validity, we will take reasonable measures such as pro-rated refunds.

8. Changes to these terms

We may amend these terms when necessary and will give prior notice of material changes through the Service.

9. Governing law

These terms are governed by the laws of Japan. The district court having jurisdiction over our place of business shall be the exclusive court of first instance for any dispute.
